  • What are the options to seal my record in San Antonio?
    In San Antonio and throughout Texas, individuals have two primary options to seal their criminal records: expunctions and non-disclosures.
  • What is the difference between an expunction and a non-disclosure in Bexar County?
    Expunction, also known as expungement, completely removes the record of an arrest, charge, or conviction from public view as if it never occurred. This option is typically available for cases that were dismissed, resulted in an acquittal, or were never filed by the district attorney, and the statute of limitation has passed. An Order of Non-disclosure allows individuals to seal their criminal records from public access, but certain government agencies and law enforcement may still be able to view them. Non-disclosures are available for certain crimes if specific eligibility criteria are met, usually completing a waiting period after the successful completion of probation or deferred adjudication. Both expunctions and non-disclosures offer a chance for individuals in Bexar County and the surrounding area to move forward with their lives free from the stigma of a criminal record, and our team is here to help navigate which option is best suited to your unique situation.
  • Do I qualify for an expunction in San Antonio?
    Generally, in San Antonio you are eligible for an expunction if your charges were dismissed, resulted in an acquittal, or were never prosecuted and certain appropriate time periods have expired The most common reasons you may not be eligible for an expunctions are: - You were convicted of the offense. This occurs if you pled guilty or no contest for the offense and were sentenced to pay a fine or serve a sentence in county jail, state jail, or prison. If you received a conviction for the offense, there is typically no option to seal your records unless you receive a Governor's pardon, your conviction is overturned by a higher court, or you were convicted of Unlawfully Carrying a Weapon before September 1, 2021. - You were placed on probation or deferred adjudication for the offense. (Deferred probation for a Class C misdemeanor punishable by fine only is still eligible for an expunction). If you successfully completed deferred adjudication probation and were not convicted, you may be eligible for an Order of Non-disclosure. - You were arrested and the District Attorney's office has not filed charges but the applicable waiting period has not expired. - Some of your charges were dismissed but you were convicted of other offenses arising out of the same "criminal episode." In Texas, a criminal episode refers to a sequence of connected criminal actions that are committed during a continuous period and are closely related in time, place, and circumstance.
  • Do I qualify for an Order of Non-Disclosure in San Antonio?
    Generally, if you successfully completed deferred adjudication for a misdemeanor or felony offense and fulfilled all requirements, you may be eligible to petition for a non-disclosure order in San Antonio and throughout Texas. However, certain offenses, such as those involving family violence, sexual offenses, and certain types of DWI offenses, may not be eligible for non-disclosure. Additionally, there may be waiting periods before you can apply for non-disclosure, and other specific criteria must be met.
  • Why might I be disqualified for an Order of Non-Disclosure in Bexar County, Texas?
    You are not eligible for an Order of Non-Disclosure for ANY OFFENSE if you have ever been convicted or placed on deferred adjudication probation for any of the following crimes at any time, even if it is unrelated to the offense you want to seal. An offense requiring registration as a sex offender. Any other offense involving family violence. Aggravated Kidnapping Murder Capital Murder Trafficking of Persons and Continuous Trafficking of Persons Injury to a Child, Elderly Individual, or Disabled Individual Abandoning or Endangering a Child Violation of court orders or conditions of bond in a family violence, sexual assault or abuse, stalking, or trafficking case.   • Can I Qualify for an Order of Non-Disclosure on a DWI in San Antonio?
    If you were placed on deferred adjudication for a DWI in San Antonio, Texas you are likely eligible for an Order of Non-Disclosure if: This is your first Driving While Intoxicated offense; Your blood alcohol concentration was less than 0.15; You have never been convicted of another crime or placed on deferred adjudication community supervision (minor traffic offenses excluded); You have successfully completed all the requirements of your deferred adjudication probation; and The applicable waiting period for petitioning the court has elapsed. Waiting periods to obtain an order of non-disclosure for a DWI are: Two Years - If you were ordered to install an ignition interlock device on your car for at least 6 months as a condition of your probation. Five Years - If the court did not order that your install an ignition interlock device on your car.
  • Can I deny I was ever arrested after an expunction?
    Upon the completion of the expunction process and the issuance of a final order, you can disavow any record of your arrest and subsequent expunction across applications for employment, educational pursuits, or military enlistment. Under oath, you can even swear you were never arrested for the offense in civil proceedings but must still admit the arrest in criminal proceedings if asked.
  • If I pled guilty or no contest, do I qualify for an expunction?
    Generally, the answer is no. If you pled guilty to a Class A or B Misdemeanor or Felony charge, you cannot get an expunction. You may still be eligible if you pled to a Class C Misdemeanor and were placed on deferred adjudication. There is also an exception for UCW convictions before September 1, 2021.
